The Council denied our Special Exception that was recommended by the LPA Boardat the Nov 18th 2020 Council hearing. Kurt and I had a window of 15 days to appeal to the Town for a rehearing, which we did. That hearing was on Jan 21st. and we were granted the request for a new hearing on Feb 18th.
Under Florida State Statute, Kurt and I had 30 days from the Town's denial of our Special Exception to request the Town to employ a Magistrate to mediate our differences. We made that request but cancelled the mediation process after the Town attorney repeatedly ignored time lines and requests to reply.
At the rehearing on Feb18th 2020, our attorney and Kurt and I came prepared to show new evidence and new information. From the start of the meeting it was obvious to our attorney and Kurt and I that the Council meeting had been pre orchestrated before it had begun and we were not even allowed to present our new information and were shut down before we were given a chance. Kurt and I were not allowed to speak.
After such an embarrassing display by the Town council, Kurt and I moved forward with our claim for damages and continue to move forward with the Bert J Harris lawsuit against the Town.
